Glide Adventure Tours, LLC release of Liability

Whereas each of the undersigned individuals/participants are desirous of using a Segway® Personal Transporter provided by Glide Adventure Tours LLC and are doing so entirely upon his or her own initiative, risk, and responsibility. 

I am completely aware of and accept the risk and hazards inherent upon the use of the Segway® Personal Transporters. 

Now therefore, in consideration of use of Glide Adventure Tours LLC, Segway® Personal Transporters, whether with or without charge, each of the undersigned individually, and/or as a representative of and on behalf of his or her employer, spouse, child, or ward, hereby release, discharge and covenant not to sue Glide Adventure Tours LLC and/or their agents, officers, servants, representatives, and employees of and from any liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including fatal injury sustained while using, participating, and /or renting the Segway® Personal Transporter, whether or not caused by the negligence of Glide Adventure Tours LLC or its employees, agents, officers, servants, representatives, or by failure of the equipment.

This release shall be binding upon the spouse, heirs, legal representatives, next of kin, executors, and administrators of each of the undersigned. In signing the foregoing release, each of the undersigned acknowledges and represents that he/she has read the foregoing release, understands and signs it voluntarily, that he/she is at least 12 years of age and has parental approval as evidenced by signed authorizations below if under the age of 18 years; is of sound mind and that he/she has not and will not consume any alcohol or ingest drugs that might alter their perception, consciousness, cognition or behavior; that he/she agrees to follow any and all state, county, and city statues pertaining to the use of the Segway® Personal Transporter; and that he/she is in good health, suffering from no physical disability which might impair his/her mental or physical faculties.

I understand that helmets are provided and must be worn at all times to use all Segway® Personal Transporters.

I have been, or will be, given instruction on the safe use of the Segway® Personal Transporter and have watched the Segway Training Video either on the Glide Adventure Tours LLC website or in their place of business prior to my training. I will not continue with this activity if I do not feel that my training was adequate, do not feel safe or do not feel physically able to operate the equipment safely at any time during the activity.

I understand that this activity may be affected by hazards posed by pedestrians, automobiles and other vehicles as well as road, sidewalk and off-road trail or dirt pathway conditions that I will encounter during the normal course of the tour. I confirm by signing this form that my physical weight is over 100 lbs and under 260 lbs and that I am at least 12 years of age.

I accept financial responsibility for any injury to pedestrians or damage(s) to property or automobiles while operating the Segway® Personal Transporter and agree to provide reimbursement for any such injury or damage.

I agree to reimburse Glide Adventure Tours LLC for any loss or damage of any kind to their equipment while in my possession, other than reasonable wear and tear.

I understand that riding on a Segway® Personal Transporter and related activities can be dangerous and involve a risk of injury, which may even be fatal.  Despite the risk of injury, I agree to expressly assume all risks of injury or death to me while participating in this activity on a Segway® Personal Transporter.

This document is implemented from the date of signature of the undersigned person/persons and it will be in effect for a period of one (1) year from the date of my signature.

I HAVE READ AND FULLY UNDERSTAND THE FOREGOING RELEASE AND PARTICIPATE AT MY OWN RISK.

I HAVE READ THIS DOCUMENT IN ITS ENTIRETY.  I UNDERSTAND IT IS A RELEASE OF ANY AND ALL CLAIMS.

I UNDERSTAND I EXPRESSLY ASSUME ALL RISK INHERENT TO THE USE OF THE SEGWAY® PERSONAL TRANSPORTER, AS WELL AS PARTICIPATING IN AND OBSERVING ANY SEGWAY® PERSONAL TRANSPORTER ACTIVITY, INCLUDING BUT NOT LIMITED TO THE USE OF THE SEGWAY® PERSONAL TRANSPORTER, AND ANY AND ALL EQUIPMENT. 

I have carefully read this agreement and understand its content.  I am aware this is an assumption of risk and responsibility, waiver and release of liability and I sign it voluntarily. I also understand that I should not and may not participate in this activity if I am under the influence of alcohol or drugs. 

I VOLUNTARILY SIGN MY NAME EVIDENCING MY ACCEPTANCE OF ALL THE ABOVE PROVISIONS. 

THIS IS A RELEASE OF LIABILITY.  DO NOT SIGN IF YOU DO NOT AGREE TO THESE TERMS OR DO NOT UNDERSTAND THEM!
